NYPD officer charged with perjury in Queens gun case

NYPD Officer Accused of Fabricating Evidence in Queens Gun Case, Charged With Perjury

A 48-year-old NYPD officer has been suspended without pay and charged with perjury and other crimes related to a botched gun possession case in Queens. The investigation into Officer Miguel Vanbrakle began after his body camera footage contradicted his account of the events surrounding a search warrant executed at a home in Cambria Heights last October.

According to prosecutors, Vanbrakle claimed to have recovered a loaded .38-caliber revolver and a New York state benefit card belonging to the homeowner's fiancé during the search. However, the homeowner had stated that the gun belonged to her. Despite this discrepancy, the fiancé was indicted on weapons possession charges, only to have the case dismissed in December.

Vanbrakle's own body camera footage revealed that he had actually removed a shoe box from the living room, taken the benefit card from it, and placed it in the safe where the gun was later found. Prosecutors have accused Vanbrakle of planting evidence to tie the fiancé to the gun, but the Police Benevolent Association, which represents Vanbrakle, disputes this characterization.

"We are entitled to due process, not a rush to judgment based on a misleading press release," said Patrick Hendry, president of the PBA. "The facts will come out in court." The union claims that the various pieces of evidence recovered during the search were part of the NYPD's vouchering process and do not reflect Vanbrakle's actions.

Vanbrakle faces up to seven years in prison if convicted on charges including falsifying business records, tampering with physical evidence, official misconduct, and making a punishable false written statement. He is set to appear in court on February 23.

Can you believe this? Some cops really need to get their act together... I mean, come on, who tries to plant evidence in a shoe box?! 🤦‍♂️ Vanbrakle's actions are basically like something out of a bad cop show, and now he's facing serious time. The fact that his own body cam footage contradicted his story is just the icing on the cake. I'm all for due process and whatnot, but this is some next-level BS. 🤔 It's not exactly a shock that the Police Benevolent Association is sticking up for him, though – they always look out for their own interests first. Still, this whole thing reeks of a botched investigation and a cover-up. Fingers crossed justice gets served on February 23... 💼

omg like what the f**k is going on here?! 🤯 NYPD officer fabricating evidence? that's like something out of a movie! I'm not surprised though cuz police can be super sketchy sometimes. but like, perjury and all these other crimes? that's serious stuff. I hope Vanbrakle gets what's coming to him tho, he needs to make an example outta himself so others don't try this kinda thing in the future. but at the same time, I feel bad for his fam and the fact that he got in trouble over a misunderstanding... anywayz, I'm def watching this case unfold on the news and will be low-key rooting for justice

man, this one's got me thinkin'... like how can someone just make up stuff like that? 🤔 i remember back in the day, my brother was involved with the NYPD as a volunteer, and he told me about all these cases where people would just fabricate evidence to get ahead. it's crazy! anyway, this Vanbrakle guy is supposed to be a career cop, but he can't even be trusted with his own story 🙄. and now he's facing some serious prison time... like, what's the point of even having an investigation if you're just gonna plant evidence? 🚫 it's just not right, you know?

this is just another example of how our system can be broken 🤦‍♂️... i mean, who fabricates evidence and plants it like that? 🚫 it's crazy that some people think they're above the law.

i'm not saying Vanbrakle didn't do what he did, but it's wild to me that this went on for so long without anyone questioning it. like, what's going on with our police departments these days? are we just supposed to trust them completely now? 🤔 i've seen some shady stuff in my time online, but this is just straight up crazy.

anyway, good for the prosecution for finally taking action and holding someone accountable... let's hope Vanbrakle gets what's coming to him.

🤔 I'm still trying to wrap my head around this whole thing... how can one person just plant evidence like that? It's crazy! 🙄 and it makes me wonder what other cases might have been messed up because of his actions. The fact that he was able to get the fiancé indicted in the first place is mind-blowing. And now, with all these charges against him, I hope justice is served ASAP so we can move on from this whole thing. 🕰️

😱 can u believe this dude got caught red handed? like how could he just fabricate evidence and put innocent ppl's lives at risk? 💔 the fact that he planted evidence to tie the fiancé to the gun is straight up despicable 🤢 and now he's gonna face 7 years in prison if convicted...that's a pretty steep price to pay for his mistakes 👎

Come on! 🤯 A cop fabricating evidence? That's just not cool, fam 😎. I mean, we all know the system's flawed, but this takes it to another level. It's like he wanted that guy to take a plea deal and get outta there. Vanbrakle's gonna get his 7 years if he gets convicted 🕰️. You gotta wonder what went on behind the scenes - was there some kind of pressure from above? The fact that the PBA is all "due process" and whatnot just seems like a PR stunt to me 📢. Anyway, I hope Vanbrakle's lawyers can get him off on this one 🤞.

🤔 This whole thing sounds pretty messed up... I mean, can you imagine finding out that a cop lied about what they found during a search warrant? It's like, the whole system gets compromised. The fact that this officer was able to plant evidence and make it seem like someone else owned the gun is just crazy. 🙄 And the best part is, he thought he could get away with it too... I mean, who plants fake evidence and then plays dumb when questioned about it? It's just so much red flag after red flag. The police union trying to spin this as a "rush to judgment" thing doesn't sit well with me either... seems like they're just trying to cover their officer's tracks. Anyway, it's clear that justice needs to be served here and Vanbrakle will have to face the consequences of his actions. Hopefully, he gets the help he needs before then 🤞

This whole thing is just super messed up 🤦‍♂️. A cop planting evidence? That's like something out of a bad TV show. I mean, can you believe this guy was suspended without pay and now charged with perjury? He's basically admitting to lying under oath 💔. The fact that he was able to fake his way through the whole thing, even making it seem like the homeowner's fiancé was guilty, is just crazy 🤯. And now we're talking about a guy potentially facing 7 years in prison for this? It's just so unfair 🙄.

omg u guys i cant even lol i mean i knew something was off about that whole gun case in queens but i didnt think it was that deep. so apparently this nypd officer miguel vanbrakle was involved and he fabricated all these things including the gun supposedly found at the house. like why would anyone do that? i guess we'll just have to wait and see how it all plays out in court

i feel bad for the guy who got indicted on those weapons charges, though. poor dude. i hope they drop the charges or something. and can u believe this officer was supposed to be a hero but turns out he's been lying the whole time? ouch. anywayz ill keep an eye on this case lol

🤔 I'm like totally not surprised by this news. I mean, we all know that our police officers are under so much pressure to meet quotas and deal with the stress of the job. It's crazy how one little mistake can snowball into a huge scandal. The thing is, Vanbrakle was supposed to be a respected member of the community, but now it seems like he's just another example of corruption in the system 🚫. I'm all about due process and fairness, so let's hope that justice is served here. We need more transparency and accountability from our law enforcement agencies 👮‍♂️. The fact that Vanbrakle is being charged with perjury and other crimes sends a strong message that we won't tolerate this kind of behavior 🚫💪.

just saw this and my mind is blown 😱 how can u fabricate evidence like that? it's not just about the punishment, but about the principle of the thing... i feel so bad for the fiancé who got dragged into all this because of some officer's mistake. it's a huge trust issue with law enforcement and it needs to be addressed ASAP 👮‍♂️

🚨 This is a total mess! I mean, how can you fabricate evidence like that? It's not just about the officer, it's about the entire system failing. I'm all for holding people accountable, but this is ridiculous. The fact that the fiancé got indicted and then had the case dismissed shows exactly what we're talking about here - a botched investigation. And now Vanbrakle's gonna get time? It just don't sit right with me... 6 months in my opinion would've been enough

man this is crazy 🤯 the thought of someone fabricating evidence like that is just mind-blowing... what's even more disturbing is that it could've led to an innocent person getting wrongly accused and locked up 💔 i hope Vanbrakle gets a fair shake in court, but the fact that his own union is disputing some of the details already makes me skeptical 🤔 can't we just focus on getting justice for everyone involved instead of worrying about who's right or wrong? 🙏 let's keep our eyes peeled and support each other through this! 💕

Ugh, this is so messed up 🤯! I mean, can you believe an NYPD officer would fabricate evidence like that? It's just not right. The fact that he planted the gun and the benefit card to frame the fiancé is just disgusting 😷. And now he's being charged with perjury and other crimes, which is about time 💪.

I'm also really frustrated with the Police Benevolent Association trying to spin this as a case of due process being rushed. Come on, guys! You can't just make up evidence to frame someone and then try to cover it up 🤥. The fact that he's accusing prosecutors of rushing to judgment is just laughable 😂.

I'm glad the homeowner got their life back in order when they had the case dismissed, but this whole ordeal was a nightmare 🌃. I hope Vanbrakle gets the justice he deserves and serves some serious time behind bars 👮‍♂️.

🤔 just when you think the NYPD can't get any more interesting... this guy's got some 'splainin' to do 😒. I mean, who tries to fabricate evidence in a gun case? seems like he was trying to make himself look like a hero or something 💪. but really, it's just a big ol' mess 🤯. and the police union is all "due process" but like, come on... this guy broke the law 🚔. I hope he gets what's coming to him 👮‍♂️.

🤔 This whole situation with Officer Vanbrakle is super concerning... I mean, you've got this guy accused of fabricating evidence and manipulating the system just to frame someone else 🚫. It's like, what's the point of having a police department if they're gonna prioritize their own interests over justice?

And it's not just about Vanbrakle himself, it's also about the whole process that led to this guy being indicted in the first place. I mean, how do you get someone to plead guilty to something they didn't even do? 🤷‍♂️ It just seems so... botched.

I'm all for due process and everyone getting a fair shake, but it feels like there's some kind of cover-up going on here 😒. And what really gets me is that the police union is pushing back against these allegations, claiming that they're being unfairly targeted by prosecutors 🚫. It just seems like a classic case of "us vs them" to me.

Anyway, I'm keeping an eye on this one... it's gonna be interesting to see how it all plays out 👀

🤕 Can't believe what's going down here... a cop faking evidence? It's like something out of a movie, but it's real life and someone's losing their freedom over it. I feel sorry for the homeowner and her fiancé - they got caught up in this mess because of Vanbrakle's lies. 🤦‍♂️ This just goes to show that even those in power are not above the law... you can't fake your way out of accountability 💼
